Former SH couple face multiple charges after shootout

A husband and wife, listed as Sweet Home residents, are facing charges in Linn County in connection with a March 25 high-speed chase and shootout were indicted last week on crimes committed in Lane County on March 19 and 20.

The couple has had contact by the Sweet Home Police from Jan 2014 through March 2016, with listed addresses in Sweet Home.

Linn County Court documents list Brian Eller, 39, as a transient in Sweet Home.

While court documents list Kimberly Eller, 36, as transient from Albany, she is listed in SHPD records on four of the five contacts with Brian Eller from January 2014 to February 2016.

Detailed information about the reasons for the SHPD contact was not available at press time.

Brian Eller was charged with one count of unauthorized use of a vehicle on March 19.

The additional nine counts relate to incidents on March 20:

– One count of second-degree robbery for threatening physical force upon another person he was trying to take a vehicle from; court documents say he was armed with a dangerous or deadly weapon;

– Five counts of unauthorized use of a vehicle – these vehicles included a Chevy pickup with a camper, a Chevy van, a dump truck and a forklift from Roger Langeliers Construction; and another Chevy pickup;

– One count of first-degree criminal mischief for damaging or destroying property belonging to Roger Langeliers Construction in an amount exceeding $1,000;

– One count of first-degree burglary; and

– One count of first-degree aggravated theft for stealing personal property including firearms and jewelry worth $10,000 or more.

Kimberly Eller was charged with one count of unauthorized use of a vehicle on March 19.

– Five counts of unauthorized use of a vehicle – these vehicles included Chevy pickup with a camper; a Chevy van; a dump truck and forklift from Roger Langeliers Construction; and another Chevy pickup;

– One count of first-degree criminal mischief for damaging or destroying property belonging to Roger Langeliers Construction in an amount exceeding $1,000;

– One count of first-degree burglary; and

– One count of first-degree aggravated theft for stealing personal property including firearms and jewelry worth $10,000 or more.

In Linn County, Kimberly Eller has been charged with four counts of unauthorized use of a vehicle. She is being held in Linn County Jail. A settlement conference is scheduled for June 30.

In Linn County, Brian Eller has been charged with two counts of attempted aggravated murder with a firearm, two counts of first-degree attempted assault with a firearm, felon in possession of a firearm, two counts of attempting to flee or elude police officer, reckless driving, recklessly endangering another person, and unlawful possession of methamphetamine. He is being held in Marion County jail. An early resolution conference is scheduled for July 13.

On June 4, state filed a notice of intent to seek an enhanced sentence if Kimberly Eller is found guilty based on the fact that she was in possession of a firearm during the March 25 incident, which created a heightened threat of harm to law enforcement officers.
