Alleged attempted cop shooter charged

Brian Eugene Eller faces 10 charges from a March 25 shootout which left him critically injured.

Eller, 39, who is listed in court records as being from Sweet Home, is charged with two counts of attempted aggravated murder with a firearm, two counts of first-degree attempted assault with a firearm, felon in possession of a firearm, two counts of attempting to flee or elude police officer, reckless driving, recklessly endangering another person, and unlawful possession of methamphetamine.

Eller, with his wife Kimberly Eller as a passenger, led Linn County Sheriff’s deputies on a high-speed chase that ended in a field near the corner of Saddle Butte Road and Seven Mile Lane. Both Ellers fled the car and ran toward an orchard.

According to a multi-agency investigation, Eller shot at Senior Deputy Ryan Keys. Deputy Colin Pyle, who had tackled Kimberly Eller and dislodged her gun, fired at Brian Eller. He shot at both deputies and they returned fire, which resulted in Eller’s injuries.

Both deputies were found to be justified in using deadly force in the incident.

Kimberly Eller has been charged with four counts of unauthorized use of a vehicle. She is being held in Linn County Jail on $150,000 bail. An early resolution conference is scheduled for May 25.

Brian Eller is being held in Marion County jail. His bail is set at $500,000. His next court date is May 23.
