Jerry Ray Milligan, 64, who is accused of killing his son, Jerry Tyler Milligan, 41, was arraigned last week on charges of murder and two counts of unlawful use of a weapon; and he is being held without bail.
He was scheduled for another arraignment Monday following grand jury.
Last week, an autopsy confirmed that the cause of death was a gunshot wound by a .22-caliber pistol that appears to have been fired once, said Sweet Home Det. Cyndi Pichardo.
Alcohol was a factor in the incident, Pichardo said, but the cause of the struggle between the two men remains unknown.
Police are awaiting a toxicology report, she said.
“There was evidence of drug use (marijuana) found at the scene,” said Police Chief Bob Burford. That’s part of the reason police are running a toxicology screen.
Sweet Home police arrested the elder Milligan on Feb. 19 after a neighbor reported that he had come to her house and asked her to call the police because he had just shot someone.
The two men had been involved in a struggle prior to the shooting.
